1. Introduction

These Terms and Conditions ("Terms") govern your use of the messaging services ("Services") provided by 4thCode OÜ ("we", "our", or "us") via SMS, Viber, and other messaging channels. By using our Services, you agree to be bound by these Terms and all applicable laws.

2. Eligibility

You must be a business user and have the authority to enter into this agreement on behalf of your company or organization.

3. Services

We provide an API and a web dashboard for sending and tracking service messages via supported messaging channels. Message delivery is subject to third-party infrastructure (e.g. telecom providers, platform APIs, messaging gateways).

4. Customer Responsibilities

Provide accurate information during registration

  • Ensure proper use of the platform and secure access to API credentials

  • Comply with all local laws, including GDPR, PECR, and messaging regulations

  • Do not use the Services for unsolicited or prohibited content

5. Message Content

You are solely responsible for the legality and accuracy of the content sent via our platform. We may suspend or terminate accounts used to send fraudulent, unlawful, or abusive messages.

6. Fees and Payment

Service fees are outlined in your commercial agreement or offer. Payments are due within 14 days of invoicing unless agreed upon differently in writing. We reserve the right to suspend service for late or unpaid invoices.

7. Intellectual Property

All intellectual property related to our platform (including but not limited to software, code, branding, documentation) remains our exclusive property. You may not copy, reverse engineer, or resell the platform without permission.

8. Service Availability

We aim to maintain uptime (availability) and reliable message delivery. However, availability may be affected by factors outside our control. See our Service Level Agreement for more details.

9. Termination

We may terminate or suspend your access for violations of these Terms. You may terminate the agreement at any time with written notice.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect or consequential damages, including loss of profits, data, or reputation.

11. Governing Law

These Terms are governed by the laws of the Republic of Estonia.
